Public Offer Agreement

Public offer agreement for Tomyo Plus subscription services, including payment terms, refund policy, and service conditions.

1. General Provisions

This document constitutes an official proposal (public offer) by self-employed individual Maxim Mikhailovich Zelensky, TIN 234807956734 (hereinafter referred to as the "Provider"), addressed to any individual (hereinafter referred to as the "Customer"), and contains all essential terms for providing access to the paid features of the Tomyo service.

In accordance with Article 437 of the Civil Code of the Russian Federation, this document constitutes a public offer. Acceptance of the offer is the payment for services by the Customer in the manner and under the conditions specified in this agreement.

2. Subject of the Agreement

The Provider grants the Customer access to the paid features of the Tomyo service (Tomyo Plus subscription) at https://tomyo.app and in the Tomyo mobile applications for the period selected and paid by the Customer.

Tomyo Plus subscription includes:

  • Sessions with vocabulary, grammar, and character keys
  • Unlimited number of lessons per day
  • Grammar training — sentence building
  • All materials for self-study
  • Crown on avatar and Plus badge

3. Service Cost and Payment Procedure

Tomyo Plus subscription pricing:

  • 1 month — 299 RUB
  • 3 months — 749 RUB
  • 6 months — 1,399 RUB
  • 12 months — 2,399 RUB (+1 bonus month)

Payment is made in Russian rubles through the Robokassa payment service (LLC "ROBOKASSA"). Visa, Mastercard, MIR bank cards are accepted, as well as other payment methods available through the payment service.

The payment date is the date when the funds are received by the Provider. Access to paid features is granted after payment confirmation by the payment service.

4. Subscription Duration

The subscription is activated upon payment confirmation and remains active for the paid period. Upon expiration, access to paid features is restricted to the free Basic plan level.

The subscription does not renew automatically. To continue using paid features, a new payment must be made.

5. Refund Policy

The Customer may cancel the service and request a refund within 3 (three) calendar days from the date of payment, provided that the paid features have not been used.

To request a refund, please contact support at sendmail@tomyo.app, including the payment number and reason for the refund.

Refunds are processed using the same payment method within 10 business days from the confirmation of the refund request.

No refund is provided if the Customer has used the paid subscription features (completed lessons, accessed paid materials, or used grammar trainers).

6. Rights and Obligations

The Provider undertakes to:

  • Provide access to paid features after payment confirmation
  • Maintain the service in reasonable working order
  • Respond to Customer inquiries within a reasonable timeframe

The Customer undertakes to:

  • Pay for services in accordance with the selected plan
  • Not share account access with third parties
  • Comply with the Terms of Service

7. Liability

The Provider is not liable for the inability to use the service due to reasons beyond the Provider's control (internet issues, Customer's device problems, force majeure circumstances).

The Provider does not guarantee specific learning outcomes. The service provides tools for learning Chinese; results depend on the Customer's efforts.

8. Personal Data

Processing of the Customer's personal data is carried out in accordance with Federal Law No. 152-FZ "On Personal Data" and the Privacy Policy of the Tomyo service.

9. Amendments

The Provider reserves the right to unilaterally amend the terms of this offer. Changes take effect upon publication of the new version on the website. Active subscriptions are served under the terms in effect at the time of payment.
