Terms of Service

These terms govern the use of the Tomyo website, user accounts, service materials and the features related to studying, reading and signing in through external providers.

1. Acceptance of the terms

By using https://tomyo.app, the Tomyo mobile apps and the related services, you agree to comply with these Terms of Service and with our Privacy Policy. If you do not agree with these terms, do not use the service.

2. Description of the service

Tomyo provides digital tools for learning Chinese, storing notes and quotes, managing study materials, keeping journals, practising dialogues and using the related AI features. We may change, update, suspend or remove individual features at any time.

3. Registration and account

Some features require an account. You agree to provide accurate and up-to-date information when registering and to keep your credentials secure.

  • You are responsible for every action taken through your account.
  • You agree to notify us without delay about any unauthorised access.
  • We may refuse registration, restrict an account or close it if these terms are violated.

4. Sign-in through third-party providers

Tomyo may allow signing in through third-party providers, including Google and Apple. By using such a sign-in you also agree to the rules and policies of the respective provider. The availability of these sign-in methods depends on external services and is not permanently guaranteed.

5. Acceptable use

You agree to use Tomyo only in a lawful and good-faith manner.

  • Do not violate applicable law or the rights of third parties.
  • Do not attempt to gain unauthorised access to the infrastructure, data or accounts.
  • Do not upload malicious code, spam, fraudulent materials or illegal content.
  • Do not use the service for automated abuse, scraping or circumventing usage limits.
  • Do not impersonate another person or organisation.

6. User content

You retain the rights to the content you create and upload to Tomyo, including notes, quotes, journal entries, vocabulary, answers and other materials. At the same time you grant us a limited licence to store, process, display and transmit that content to the extent necessary for the service to operate.

You confirm that you have the right to post such content and that it does not infringe the rights of third parties.

7. Intellectual property

All rights to the software, interface design, the Tomyo brand, service texts, graphics and other materials created by us belong to Tomyo or are used on lawful grounds. You are granted a limited, non-exclusive and revocable right to use the service for personal purposes only, in accordance with these terms.

8. AI features and recommendations

Some Tomyo features use artificial intelligence models to generate dialogues, exercises, translations, hints and recommendations. Such results may be inaccurate, incomplete or unsuitable for a particular situation, and are provided for informational and educational purposes only.

  • You assess the correctness and suitability of AI results yourself.
  • Tomyo does not guarantee any pedagogical, medical, legal or other professional outcome.
  • We may limit the use of AI features to protect the service and control its costs.

9. Service availability

We aim to keep Tomyo running reliably, but we do not guarantee that the service will be available continuously and without errors. Interruptions, maintenance, updates and restrictions by region, by device or by individual integration are possible.

10. Termination of access

You may stop using the service at any time. We may also temporarily restrict or fully terminate access to an account if we believe that you have violated these terms, or that you create risks for other users, for the infrastructure or for compliance with the law.

11. Disclaimer of warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no express or implied warranties as to the fitness of the service for a particular purpose, its freedom from errors, full compatibility, uninterrupted operation or absolute security.

12. Limitation of liability

To the maximum extent permitted by law, Tomyo is not liable for indirect, incidental, special, punitive or consequential damages, nor for lost profit, loss of data, loss of business reputation or business interruption arising in connection with the use of, or the inability to use, the service.

13. Changes to the terms

We may update these Terms of Service from time to time. If the changes are material, we will make an effort to notify users through the website, the app or by email. Continuing to use Tomyo after the updated terms take effect means that you accept the new version.

14. Governing law and disputes

These terms are governed by the applicable law of the jurisdiction in which the operator of the service acts, unless the mandatory rules of the user's local law require otherwise. Before going to court, the parties will where possible seek to settle the dispute through negotiation.
